This Agentyfy (operated by Spicyfy Ventures LLC) Terms and Conditions, along with the Privacy Policy, constitute an Agreement established by and between Spicyfy Ventures LLC and the Customer by virtue of the Customer registration to the Services through the applicable Company website and is effective as of the date of the Customer registration to the Services (the "Effective Date"). By accepting the Agreement, the Customer confirms that they have read, understood and accepted its contents.
"Company," "We" , "Us" means Spicyfy Ventures LLC. The worldwide corporate headquarters and principal office of the Company shall be Dallas, Texas.
"Customer," "You" means any user, person, or entity who creates an account and uses Services supplied by the Company under the Agreement.
"Services" means the services and products supplied by the Company to the Customer under the Agreement, including Agentyfy.ai.
"Personal Data/Personal Information" means personal data within the meaning of the GDPR, processed by Spicyfy Ventures LLC on behalf of the Customer pursuant to, or in connection with, the Agreement.
Spicyfy Ventures LLC provides AI automation services including Agentyfy.ai. Accepting these Terms and Conditions, along with the Privacy Policy, is a condition of using the Services provided by Spicyfy Ventures LLC.
Spicyfy Ventures LLC may modify the provisions of the Agreement, and only those currently visible on our website are up to date and binding. Such changes shall take place with prior explicit notification to the Customer at least thirty (30) days before the change implementation.
Spicyfy Ventures LLC provides the Customer with access to AI automation software available on Agentyfy.ai and related platforms. The software used by the Customer in accordance with its application and purpose defined in the Agreement shall be deemed Services.
Spicyfy Ventures LLC is exclusively entitled to add, change, remove, and adapt the functionality, the use, subject matter, and the range of particular Services, including the software provided, its contents, and its nature.
Spicyfy Ventures LLC Services are exclusively designated for business use and must be used only in accordance with their contractual intended purpose, aim, and the Agreement.
The Customer must be at least 13 years of age to be able to register and to access their Account. Spicyfy Ventures LLC does not knowingly provide Services to any person under the age of 13.
The Customer undertakes to use the Services exclusively for its own purpose and in a manner consistent with the currently effective law and the Agreement.
This Acceptable Use Policy applies to Spicyfy Ventures LLC Services accessible through Agentyfy.ai and related platforms. The Customer may not:
Spicyfy Ventures LLC is dedicated to providing data protection and to promote compliance with rules set forth by the European Union and other applicable regulations.
The Customer shall comply with Data Protection Laws and Regulations, including being authorized to pass on personal data to Spicyfy Ventures LLC for the purposes stipulated in the Agreement.
Spicyfy Ventures LLC will never sell, rent, or lease Customer service data to any third party. We will not share Customer service data with third parties, except as permitted by the Agreement and in order to provide, secure, and support the Services.
All information, data, text, software, graphics, commentary, video, messages, or any other materials submitted by using the Service is the property of the Customer. The Customer is solely responsible for Data collected, submitted, and generated by the Services.
The use of offered Services may include a free trial period. After the free trial period ends, if the Customer wishes to continue using the Services, payment will be required according to the currently effective price list.
All payments shall be non-cash transactions, conducted electronically. The Company provides no refunds, no right of set-off, or credits for unused time of the Services.
The Agreement shall be concluded for the term specified by the Customer (Subscription Period). The term shall automatically renew for additional periods unless the Customer closes their account or either Party terminates the Agreement.
Spicyfy Ventures LLC guarantees the highest quality of its operations to ensure accessibility and continuity of offered Services in accordance with their use and purpose.
The Company shall not be liable for damages caused by force majeure, unlawful usage of Services, third-party actions, or circumstances beyond the Company's control.
In no event shall the aggregate liability of the Company exceed the total amount paid by the Customer for the Services in the twelve (12) months preceding the first incident out of which the liability arose.
The Agreement shall be governed by the laws of the State of Massachusetts, United States of America. The sole and exclusive jurisdiction for any legal proceedings shall be an appropriate federal or state court located in the State of Massachusetts.
If any term or provision of the Agreement is invalid, illegal, or unenforceable, such invalidity shall not affect any other term or provision of the Agreement.
